This website is operated by Kala Creation (“Kala Creation”, “we”, “us” or “our”). Through‐ out the site, these terms refer to Kala Creation. We offer this website — including all inform‐ ation, tools, content and services available from it — to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms & Conditions (“Terms of Service”, “Terms”), including any addi‐ tional terms, conditions and policies referenced here or made available by hyperlink. These Terms apply to all users of the site, including browsers, vendors, customers and contributors of content.

Please read these Terms carefully before accessing or using our website. By accessing or us‐ ing any part of the site, you agree to be bound by them. If you do not agree to all of these Terms, you may not access the website or use any of its services.

1. Definitions

“Products” means the ethnic wear, Indo-Western wear and bottom wear offered for sale by Kala Creation, including kurtis, short kurtis, two-piece sets, three-piece sets, middies, co-ord sets, leggings, palazzos and related items.
“Order” means a request placed by you through the website to purchase one or more Products.
“Website” or “Site” means kalacreation.in and any sub-domain or associated online sales channel operated by Kala Creation.
“You” or “User” means any person accessing or using the Website

2. Eligibility and Online Store Terms

By agreeing to these Terms, you represent that you are at least eighteen (18) years of age, which is the age of majority under the Indian Majority Act, 1875, and that you are compet‐ ent to contract under the Indian Contract Act, 1872. If you are under 18, you may use this Website only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

You may not use our Products for any unlawful or unauthorised purpose, and you may not, in using the Service, violate any applicable law of India or of your jurisdiction, including but not limited to laws relating to copyright, trademarks and data protection.

You must not transmit any worms, viruses or any code of a destructive nature. A breach or violation of any of these Terms may result in immediate termination of your access to our Services.

3. General Conditions

We reserve the right to refuse service to any person at any time, for any lawful reason.

You understand that your content (not including payment card information) may be trans‐ ferred unencrypted and may involve transmissions over various networks, and changes to conform to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service,or any content on the Website, without our express written permission.

The headings used in this agreement are included for convenience only and do not limit or otherwise affect these Terms.

4. Products, Sizing and Colour Representation

Certain Products may be available exclusively online through the Website and may be offered in limited quantities. Product availability at our physical stores and on the Website is managed separately, and listing on the Website is not a guarantee of availability at any particular store.

We make every effort to display the colours, textures and images of our Products as accur‐ ately as possible. However, the way a colour appears depends on your screen, its settings and your lighting, and we cannot guarantee that your display of any colour will be accurate. Minor variation in shade, print placement, embroidery placement and finish is inherent to garments made with natural fabrics and hand-worked detailing, and is not a defect.

Sizes are indicative and follow the size chart published on the relevant product page. Be‐ cause fits differ between styles and fabrics, we recommend checking the measurements on each product page rather than relying on a single size across the catalogue.

We reserve the right, but are not obliged, to limit the sale of our Products to any person, geographic region or jurisdiction, and to limit the quantities of any Product offered. We re‐ serve the right to discontinue any Product at any time. Any offer for any Product made on this Site is void where prohibited by law.

5. Pricing, Taxes and Payment

All prices are listed in Indian Rupees (INR) and, unless stated otherwise on the product page, are inclusive of applicable Goods and Services Tax (GST). Shipping charges, where applicable, are shown separately at checkout before you confirm your Order.

Prices for our Products are subject to change without notice. The price applicable to your Order is the price displayed at the time your Order is confirmed by us.

We accept the payment methods displayed at checkout. Payments are processed through third-party payment gateways, and your use of those gateways is additionally subject to their own terms and privacy policies.

6. Orders, Order Acceptance and Account Accuracy

Your submission of an Order is an offer to purchase. An Order is accepted only when we confirm dispatch of the Products; an acknowledgement of your Order, or the debit of payment, does not by itself constitute acceptance.

We reserve the right to refuse or cancel any Order. We may, at our discretion, limit or cancel quantities purchased per person, per household or per Order. These restrictions may in‐ clude Orders placed under the same customer account, the same payment card, or the same billing or shipping address. If we change or cancel an Order, we will attempt to notify you using the email address or phone number provided at the time the Order was placed, and any amount already paid for a cancelled Order will be refunded to the original payment method.

We reserve the right to limit or prohibit Orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update that information — including your email address, phone number and delivery address — so that we can complete your transactions and contact you as needed.

7. Shipping and Delivery

Estimated dispatch and delivery timelines are shown at checkout and are estimates only. Delivery timelines depend on the courier partner, the destination pin code and factors outside our control, and we are not liable for delays caused by such factors.

Risk in the Products passes to you on delivery to the address you provide. Please ensure the delivery address and contact number are accurate; we are not responsible for non-delivery arising from an incorrect or incomplete address.

8. Returns, Exchanges and Refunds

Returns, exchanges and refunds are governed by the Returns & Refunds Policy published on our Website, which forms part of these Terms and is incorporated into them by reference. Please read that policy before placing an Order.

Note: Where these Terms refer to the Returns & Refunds Policy, that policy is the governing document for all questions of eligibility, timelines, condition of goods and refund method. In the event of any conflict between these Terms and the Returns & Refunds Policy on those subjects, the Returns & Refunds Policy prevails.

If you send us creative ideas, suggestions, proposals, reviews, photographs, plans or other materials, whether at our request or on your own initiative and whether online, by email or otherwise (collectively, “comments”), you agree that we may at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use those comments in any medium. We are under no obligation to keep any comments in confidence, to pay compensation for them, or to respond to them.

We may, but are not obliged to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, obscene or oth‐ erwise objectionable, or that violates any party’s intellectual property rights or these Terms.

You agree that your comments will not violate the rights of any third party, including copy‐ right, trademark, privacy, personality or any other proprietary right, and will not contain li‐ bellous, abusive, obscene or otherwise unlawful material, or any virus or malware. Nothing in these Terms excludes or limits our liability where such exclusion or limitation is not permitted under applicable Indian law, including the Consumer Protection Act, 2019. Subject to that, our total aggregate liability in respect of any Order shall not exceed the amount paid by you for that Order.

You agree to indemnify, defend and hold harmless Kala Creation and its proprietors, part‐ ners, affiliates, officers, directors, agents, contractors, licensors, service providers, subcon‐ tractors, suppliers, interns and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or the docu‐ ments they incorporate by reference, or your violation of any law or the rights of a third party.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such fail‐ ure or delay results from causes beyond our reasonable control, including acts of God, flood, fire, epidemic or pandemic, strikes, civil unrest, government restrictions, courier or logistics failures, power outages or failures of telecommunications or internet infrastructure.

20. Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such a determin‐ ation shall not affect the validity and enforceability of the remaining provisions.

The obligations and liabilities of the parties incurred before the termination date shall survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our Site.

If in our sole judgement you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without no‐ tice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services or any part of them.

Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.

These Terms, and any separate agreement under which we provide you Services, shall be governed by and construed in accordance with the laws of India. The courts at Ahmedabad, Gujarat shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

24. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Informa‐ tion Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the contact details of our Grievance Officer are set out below. Complaints are acknowledged within forty-eight (48) hours of receipt and resolved within one (1) month, unless a longer period is required and communicated to you with reasons.
